DUI Reduced to Reckless Driving
DUI Dismissed. A conviction would have not only cost my client his freedom but also his career. We filed a motion to suppress the blood and the state backed down. We settled with reckless driving and he is back to work!
What is a Restraining Order?
A restraining order is a court order that prohibits a person from engaging in certain conduct. A restraining order is issued to protect an individual from another person who has allegedly engaged in harmful behavior toward the individual. The order is usually issued by a judge after the victim has filed a petition with the court. The petition is a written request for the restraining order.
These petitions are often filed in cases of:
- Domestic violence
- Stalking
- Harassment
- Sexual assault
- Criminal trespassing
- Unlawful entry into a home
- Unlawful imprisonment
- Kidnapping
- False imprisonment
- Reckless endangerment
- Reckless homicide
- Reckless assault
- Child abuse
- Child neglect
The restraining order can be temporary or permanent. A temporary restraining order (TRO) is usually issued at the time the petition is filed. A TRO is in effect until the court has a chance to hear the case and issue a final restraining order. A final restraining order is issued after the case has been fully heard by the court and the judge has determined that the victim is entitled to protection.
